Just because he ended up with the case doesn't necessarily mean he should have stayed on it. If it's true that he has a longtime partner (as I've read a couple places), then it's quite possible that he had an interest in the outcome of the case. And if he did, he should have recused himself.
The more I read about this decision, the more it sounds like a pretty hollow victory.
