Well, I guess it had to happen. I've been shut down, read all about it!!

Dear Paul,

Your domain was suspended due to a complaint received from the
anti-piracy unit of the British Phonographic industry. Find a copy of

Dear Sirs

Re: http://www.witheverylight.com/present.htm

The British Phonographic Industry Limited ("BPI") is a member of the
Internet Enforcement Group (see www.ieg-uk.org) and the UK national
group for the International Federation of Phonographic Industries
("IFPI"). Our members comprise over 300 record companies in the United
Kingdom. Between them our members are responsible for the production
or
distribution of the vast majority of sound recordings sold and/or
distributed legally within the United Kingdom. The BPI is also
mandated
to act on behalf of the members of Phonographic Performance Limited
("PPL") and the Association of Independent Music Limited ("AIM") and in
this respect, to protect the rights in the sound recordings that are
owned or controlled by members of PPL and AIM, as well those that are
owned or controlled by BPI.

Part of our work involves monitoring the internet and taking action
against persons that use, facilitate, enable and/or authorise the use
of
sound recordings in a manner that infringes the rights of the members
of
BPI, PPL and AIM.

We have identified a website that is available upon your internet
service that enables access to a large number of infringing sound
recordings. The site address is identified above.

The time and date when we accessed this site is detailed below.

Without limitation, examples of the sound recordings featured upon this
site that are owned by or licensed to our members and/or the members of
PPL and AIM are:

Section 2 of the Copyright Designs and Patents Act 1988 (as amended)

the exclusive right to do certain acts in relation to that copyright
work ("acts restricted by copyright"). Section 16 of the Act details
the acts that are restricted by copyright. Pursuant to that section,
the owner of copyright has the exclusive right to copy a work, to issue

Copyright in a work is infringed by a person who, without the licence

consent of the copyright owner, does or authorises another to do any of
the acts restricted by copyright.

complained of, is not authorised by the copyright owner or exclusive
licensee.

We look forward to your response.

What copyright is infringed with this? I thought it was just banter... Also, most other songs were never officially released by Virgin Records/Hut, so I doubt they even fall under copyright laws. But then again, I'm not a lawyer, nor do I want to be one.

Thanks for everything, Paul.

This isn't really fair, but I guess there's nothing that can be done about it.

Of course. See copyright law. We're not licensed to spread this music.

And it isn't the band who is complaining. These are just the copyright organizations doing their job.

I'm waiting for the day that someone is accused of copyright infringement because he or she is sharing Machina II. It will happen.

Yeah, but the fact is that most of the songs from MP were never released by a record company. I doubt they have any right to take those songs down without the band/songwriter (sole copyright holder) having the last word on it...

Never heard of it. But that fucking sucks. Assuming none of those songs were commercial material (I didn't read the list).

Some of that was commercial. But I realize it's the corporations and they don't have a clue what they're doing anyway. But Billy should have some knowledge of this shit since he owns the copyrights to all of it. They should be like hey BC we're busting all your fans to protect your interests and he would be all OH NO YOU DIDNT!

Or are they doing it for virgin/hut whatever?

There will always be the hub as long as someone is willing to run it, I don't think anyone even knows about it. And if they do we can host it in that country where that Pirate Bay guy lives, he's untouchable.

It really doesn't matter if the material is officially released. And that's only fair. It's not because music hasn't been released it can be copied freely.

Read the part of the mail I quoted and try to understand what it says.
"an exclusive licensee has the same rights and remedies as the copyright owner"
BPI is a member of IFPI and I assume Virgin is one of their customers.

On the other hand, didn't Billy himself allowed this (Mashed Potatoes) to get out?

He said he's fine with people sharing/trading MP. I heard it from someone who asked him. He said that's the reason he makes music, for people to enjoy.

Hes in Sweden.
The Netherlands has loose enough laws to the point where people could do it as well.
It even was in Canada until they made their own fucking retarded DMCA.
Sweden has another plus because most of their connections are pretty amazing, 20MBit+ for a home connection is not uncommon there from what I hear.

France is also pretty sweet for that. Until they shut down some web sites like this ... i guess one day it will happen.

Well I am a lawyer. I could look it up for you but i'm pretty sure their case is bogus. I can't really see how they can claim you've infringed copyright laws. I might just llok it up anyway ; )

No it's not. The mail only states their opinion on the subject. Opinions do not necessarily have anything to do with facts.

in a law case witheverylight.com would lose within the minute. there's practically nothing it could use in its defense.

it's kinda harsh the domain was suspended, but that must be the policy of the internet provider.
