That's like asking if it counts as having sex with a lawyer if the person in question wasn't currently on a case. They're still a lawyer! Though I do agree with GlasgowKiss's license to choose yay or nay.

what if they quit being a lawyer and are a sandwich maker? you're having sex with a sandwich maker then, right? a former lawyer, but if someone asks you "have you ever had sex with a lawyer" you can say no because not only was he not a lawyer, you wouldn't want to admit it anyway because lawyers are terrible in bed
