Exclamation Woman fined $1.9 million for illegal downloads for 24 songs!

Woman fined $1.9 million for illegal downloads
Posted: 07:57 PM ET

CNN

(CNN) — A federal jury Thursday found a 32-year-old Minnesota woman guilty of illegally downloading music from the Internet and fined her $80,000 each — a total of $1.9 million — for 24 songs.

Jammie Thomas-Rasset’s case was the first such copyright infringement case to go to trial in the United States, her attorney said.

Attorney Joe Sibley said that his client was shocked at fine, noting that the price tag on the songs she downloaded was 99 cents. She plans to appeal, he said.

--------------

80,000 per song. You could rob an entire record store and not pay that much in fines. What kind of crazy shit is that!?

They should make it a reasonable amount if they expect to get any compensation.

hmm. The fine she was assigned is spelled out in the copyright law. I don't think you can claim that the copyright law is unconstitutional..

but the thing is she didn't infringe on copyright law she stole property.

I'd like to see what the max fine is for stealing a 1.00 piece of music.

Let's start with the fact that the government shouldn't be in bed with the media companies and setting far beyond actual damages standards for punishments

Well, I don't know what the libertarian position is, in the sense that I don't speak for all libertarians.

My position is that intellectual property (at least in the way it is defined in copyright law) does not exist. "Digital rights" are almost always positive rights (in the same way that universal heathcare or national defence is a positive right - that is, a right that requires aggression against someone to secure or, in more libertarian terms, "homestead").

But there is the Objectivist wing that would fiercely and aggressively defend digital rights as legitimate property rights. It's one of the major splits in the movement.

Theft is theft. My problem is the government getting involved and in bed with media companies and setting damage amounts far beyond actual cash damages. These issues should be left solely to civil courts.

i would argue it is not theft. She was given a copy of a file by other kazaa users. She didn't hack into the record company archives and take the file.

That's probably why the fine was so hefty. $48 in damages for the music and $1,899,952.00 to reimburse for the costs of the lawyers.
