He purposely goes to the dining hall that she works at with his group of friends. They make sure to laugh loudly. She has a heart condition... she had open heart surgery last year... it's reoccuring now.

Christ....so no remorse on his end. I was going to say that since he was accused at least the tagline of rapist would stick with him...but it doesn't sound like its affecting him at all... There has to be something else she can do, legally I mean.

she's afraid to tell people. she told a few... he bragged about it so everyone knows. he told everyone that he got charged with rape and won the case. he said that she looked hot when she was asleep. she called it rape, he called it fun. shes been having panic attacks. she looked like shit.

You know there's a longing for justice; I mean revenge doesn't cut it sometimes. And if someone is really that scummy (which he obviously is), I don't know what would make him learn and realize what a horrible, disgusting, hurtful person he is and change that. Would being ass-slammed by 30 guys in a row do it, or would he just be so damned stupid and horrible that he'd become an even worse person? i left my criminal law and evidence books at my flat, but yeah there is.

of course dna evidence would strongly support her case, but it is not imperative.
Rape was a criminal offence before dna testing was even conducted.

but for rape, it has to be established that
a) penetration took place, and
b) that it was without consent, or was reckless as to whether it was with or without.
they're matters for the jury to consider and deduce.

Attempted rape however doesn't even require penetration to take place. Just the actus reus of an act which is more than merely preparatory to the commission of the offence which he intended to commit

There are many levels to sexual offences.

perhaps 'indecent assault' if it cannot be established that there was intercourse.

i think she should go and see a lawyer.

In the news over here there was recently talk over a TV presenter (ulrika johnson) claiming that she was raped by another several years ago.

(I realise i study english law, and not american, but i don't think there is much difference in this area)
