Liberal Talk Radio Air America Yanked in Chicago, LA

Although a new liberal talk radio network has only been on the air for less than two weeks, it is already struggling for survival as two of the top three markets yanked the programming on Wednesday because of a bounced check.

Air America Radio, featuring leftist commentators such as Al Franken and Janeane Garofalo, was abruptly pulled from the air in both Chicago and Los Angeles, the second and third largest radio markets in the United States.

Multicultural Radio Broadcasting owner Arthur Liu, who owns the WNTD-950 AM affiliate in Chicago and the KBLA-1580 AM affiliate in Los Angeles and was renting airtime to Air America, contends the liberal radio network owes him in excess of $1 million because their previous payment to him bounced.

"They bounced a check today," Liu told the Chicago Tribune. "It's a default. They have paid only a very small portion of what they owe us."

In fact, Liu said Air America had previously requested Multicultural Radio not to cash the $1 million in checks they already have been paid.

"They've been saying, 'We're going to get you the money' for the past two months," Liu commented on the security deposit he was promised prior to the launch of the new liberal network. "They're not honoring our agreement."

In a vehement reaction to Liu's remarks, Air America Chairman Evan Cohen responded in a statement, "That is an outright lie."

"Multicultural Radio Broadcasting's conduct in this matter has been disgraceful," Cohen continued. "[i]t is a clear violation of their contractual obligations, and we are seeking legal remedies against them in court."

To that end, Air America filed a lawsuit with the state Supreme Court in New York on Wednesday against Multicultural Radio for breach of contract and have sought to reinstate the liberal radio network in both the Chicago and Los Angeles markets.

In Air America v. Multicultural, the lawsuit explains that Air America "has paid all amounts due" and is "not in breach of that agreement."

Replacing the liberal radio network with Spanish talk radio on Wednesday in Chicago, the Air America representative who monitored the live feed to WNTD from New York was summarily removed from the building and the locks were changed. A similar event also took place in Los Angeles, Liu stated.

Describing this as a "drastic action" in the lawsuit, Air America said Multicultural is in violation of the agreement that calls for disputes to be settled by arbitration.

Stating that "irreparable harm" has been done to the new liberal radio network, Air America reports that they have damages to their "goodwill and reputation," loss of listeners, loss of advertising revenue and "other types of harm that cannot be quantified."

Even without the loss of the Chicago and Los Angeles affiliates, the Air America Network has been struggling to find an audience since the liberal talk network came on the air.
