Default Should juveniles serve LWOP sentences?

(08-20) 17:46 PDT Sacramento -- A bill to let prisoners appeal lifetime sentences they received for crimes committed when they were juveniles is now in the governor's hands.

Sen. Leland Yee, D-San Francisco, has been pushing the bill for three years but only last week succeeded in getting enough backing in the state Assembly, after amending SB9 to exempt offenders convicted of torture or of killing law enforcement officials.

The state Senate, which passed the bill last August, approved those changes Monday on a party line vote, 21-16, with no Republican support. It now heads to Brown, who has not taken a public position, for consideration.

While GOP Senators such as Joel Anderson, of La Mesa, said the measure would result in the "release of little psychopaths," Democrats argued it was about a belief in redemption.

If signed by Brown, SB9 would eventually let about 300 inmates sentenced as juveniles to life without the possibility of parole to ask the courts for a 25-year-to life sentence. The offenders would have to serve at least 15 years and would have to demonstrate remorse.

No there should always be parole for juvie crimes. I mean, if they raped and killed 30 people or whatever that's something the parole board has to take into consideration.

I agree with Turalyon. Some of them are "little psychopaths", no doubt, but it's a far cry to say that they all are. They should have a chance to get out eventually.

i think 'real' adulthood (in terms of decision making) doesn't start until 23 or so for most people. so i'm always sympathetic to kids who get life ruining sentences

Prison is nothing but walls that we use to keep out those society has someone deemed unfit yet we elect unfit people every year, whether it be for the preisdent or any other city official, etc.

I don't know. I also side with the victims and the families who have to live with what happened every day. It's hard to listen to someone talk about the 17 year old that murdered their daughter, and how it has been a nightmare for them since. And now, there's a chance that the person who did it, will be released.

But they sentenced someone to death. I feel bad that they made that choice at a young age, and ruined their life, but their choices have to have repercussions.

I think paroling a bunch of juveniles that were sentenced to lwop, may send a message to criminals that they can fuck up too, and get out eventually.

but don't plenty of murderers (of any age) get 25-to-life in the first place? Is there a big difference in why some get that instead of LWOP? And if so, is it mitigating to not get LWOP or is it harsh to get it?

I think that life without the possibility of parole is mandatory for 1st degree murder. At least in Ca it is.

I don't either. But listening to someone dealing with that has pulled me away from what I used to feel.

I think they should live out their time in prison. I've been in jail a few days and it was total hell. It wasn't prison, but it sure was awful. I can't imagine being locked up until I die, but I think it's a just punishment for murder.

Some of the juvenile offenses that are not murders, should be released if they have been rehabbed, I think.

if one kid could kill someone and one just try their damnedest and not, what makes it where the first one can't possibly be rehabilitated/shouldn't be released even if they rehabbed and the second one be able to get out fairly easily after, say, 20 years (at least in most states this is extremely common, even less terms are common)... it's really the same crime, isn't it? sure the results are different but if the point is just revenge then we should state it as that
