you would think, but some landlords do business pretty loosely and have no problems. then you get some idiot like my soon to be former roommate who fucks everything up, and they're forced to do it the right way. i'm sure stacy would agree that this is probably how it should be done anyway, but it's so much easier when things can be off the cuff.

I'm working for a law firm this summer that mainly represents low income people that are being evicted by their landlords (along with some family law stuff). I'm going to get to go to housing court twice a month and help fill out paperwork for people that are getting divorced. I'm hoping I'll have some kick-ass stories of pissed off poor (and now homeless!) people to report back here.

Nate, your job this summer kind of reminds me of something that my mom had to deal with recently.
She's the attorney ad litem for a 9 year old kid. The kid's mom refused to pay rent to the apartment management because they refused to respond to her complaints. The water heater was actively leaking, pipes were leaking.... the carpet in the entire apartment was soaking wet. The apartment people flat out refused to send people out to (1) fix the leak and (2) remove the carpet. The 9 year old kid finally pulled up the carpet himself one day because it started to smell. THEN the apartment starting charging the mom all of these late fees associated with not paying rent (included in rent was water/electricity). She refused to pay the late fees because it's the management's responsibilty to respond to these issues, especially when there's a kid there! So, the apartment shuts off the electricty and water to the apartment. THEN they call CPS on the mom saying, "She's living with her kid in this unit and they don't have water or electricity!" so CPS comes out and takes the kid away. Then, the apartment management kicks her out of the apartment. My mom's going to take this shit to those 'investigative reporters' on the news here, because it's some bullshit. |

hahaha well I'm glad you've got shit figured out, and hopefully she moves out when she's supposed to. My sister had a similar problem with her apt in Chicago except her roommate wasn't on the lease. My sister paid two-thirds of the rent for a few months instead of kicking the bitch out and splitting the rent 50/50 with the other roommate. My sister didn't have the balls to kick the girl out until she owed over $1k in rent she never paid, and of course none of that money was ever seen again.
It's definitely easier to just get rid of someone before it becomes a bigger problem. |

FYI - Leases (in Chicago) don't even have to be in writing if they're 1 year or more. Receipt of rent is evidence of tenancy.
Also - if a year lease is held over and landlord still accepts rent, it is a legal month-to-month tenancy. Not sure if this sheds light on any of this but netphoria keeps making it impossible for me to not get frustrated reading threads. |

hah. I didn't feel bad for my sister at all because it was her fault for getting dicked out of all that money.
plus my sister was stupid enough to sign a lease for a 3 bedroom apt and forge the 3rd persons signature when they weren't 100% sure if he was going to move in or not. she was doomed from the start. |

basically. although he paid for two parts of the deposit and the first two or three months rent until they found someone to replace him.. which was very nice of him. he dropped a couple thousand on an apt he never stepped foot in.
it was when the girl moved in to take over his part that they started having money problems. |

I've kicked out a roommate before, best decision I ever made, really alleviated the tension in the house. He didn't pay rent, still doesn't pay rent via the people he mooches off of. Freeloaders get what they deserve.
