If you choose to live in a city and county with zoning laws and ordinances, you have to abide by them. I for example couldn't keep a 15 ft high pile of donkey manure in my backyard obv and neighbors can report health insepctors on me. There was probably reasonable suspicion the guy was doing something to violate those ordinances so they had a government public health inspector come over, hence probable cause.

i wonder how many of these militia guys are also bush voters and totally ambivalent or in support of things like NSA spying. i just cant look at this and see past the cheesy militancy of these people and how they act like theyre shining knights valiantly fighting for liberty when they stop a health inspector. really a bunch of little boys with a need to feel important

ok but I just find it strange that the sheriff didn't say "that huge pile of shit in your yard is probable cause and gives us the right to enter the property" instead of that bullshit about "what are you so afraid of???" the sheriff and the inspector both looked like deer in the headlights.

edit: I guess that's just cause they're hicks.

I'm pretty sure that in most circumstances the smarmy government official is supposed to go and get a court order in order to go barging into someone's property, even if the property owner acts like a giant asshole.

Sounds like an open and shut case to get a warrant then, doesn't it? Instead whenever anyone brings up a legal issue she looks to the cop who is responding "duh.. duh.. duh" like most cops who don't understand constitutional issues.s

(b) However, a local health officer, or a person acting under the local health officer, shall not inspect property in which the local health officer has any interest, whether real, equitable, or otherwise. Any such inspection or any attempt to make such inspection is grounds for removal as provided for in this article.
(c) This section does not prevent inspection of premises in which a local health officer has an interest if the premises cannot otherwise be inspected. If the premises cannot otherwise be inspected, the county health officer shall inspect the premises personally.

We wouldn't need domestic wiretapping if we didn't let so many illegals and questionables with bad rap sheets into the country. It's the fault of security, both in policy and in personnel.

However, I am against domestic wiretapping.

this might be pretty old.

but the idea of the NSA copying every single bit of data transferred over the internet to their own computers is both awesome and extremely scary.

Seriously though, it looks like the guy was messing with his septic tank and some e. coli was traced to his property by the health inspector. If he is polluting other people's property than he needs to be prosecuted and inspected. That is more than probable cause to search. Ideally, the way this would be settled is for the wronged parties to file suit against him, but under the current situation, this is the next best thing.
