SAN FRANCISCO -- California filed a global warming lawsuit on Wednesday against Ford Motor, General Motors, Toyota and three other automakers, charging that greenhouse gases from their vehicles have cost the state millions of dollars.

State Attorney General Bill Lockyer said the lawsuit filed in U.S. District Court in Northern California was the first of its kind to seek to hold manufacturers liable for the damages caused by their vehicles' emissions.

The lawsuit also names Chrysler Motors, the U.S. arm of Germany's DaimlerChrysler, and the North American units of Japan's Honda and Nissan.

The lawsuit charges that vehicle emissions have contributed significantly to global warming and harmed the resources, infrastructure and environmental health of the most populous state in the United States.

Ford deferred comment to the Alliance of Automobile Manufacturers, an industry group which could not immediately be reached. The other automakers had no immediate comment.

Lockyer, a Democrat, said the complaint states that under federal and state common law the automakers have created a public nuisance by producing "millions of vehicles that collectively emit massive quantities of carbon dioxide."

Carbon dioxide emissions and other greenhouse gases have been linked to global warming.

The lawsuit comes after California passed legislation supported by Republican Gov. Arnold Schwarzenegger that requires the state to reduce emissions of greenhouse gases by 25 percent by 2020. California was the first state to mandate a reduction of greenhouse gases.

California has also issued rules to force automakers to cut tailpipe emissions from cars and trucks. Enforcement of those rules is being delayed by litigation from automakers.

As much as I'm all for cleaning up global warming (and drive a hybrid), spending millions on legal fees for a lawsuit that has zero chance of being successful is a big waste of resources. If Mr. Lockyer has issues with the amount of emissions, take it up with the California Air Resources Board that sets the regulations not the companies that comply with them. This is no tobacco-type lawsuit of deception. Plus, even though there is consensus on global warming, quantifying the damage done just from autos won't wash in court.

What's next? Why not also sue the power companies? And individuals too -- I mean there are people who keep the windows open while the heat is on, which adds to global warming too.

If I were a taxpayer in California I'd be pissed at wasting funds with this lawsuit. Solving global warming is a long-term process that requires new regulations and advances in technology, not a lawsuit about prior actions.

I've been doing it for over a year now and to be honest I thought it was going to bother me; it doesn't at all. I guess it helps that my customers, for the most part, are not interested in the really powerful engines. I live in a mostly lower-middle-class government town and we sell 10-1 Caravans and Calibers to big fancy Rams and Durangos. Besides, if I didn't sell them then someone else would. It's not like I have a magic power over people.

I go to church almost every Sunday, but I don't take a Hummer.

I am all for this. In my opinion, this is the best way to handle this whole issue. Well, ideally it would be a class-action lawsuit rather than the State of California, so I empathise with the "waste of tax money" argument, but this is probably the best we can hope for in terms of looking for quantification of any damages which emissions might be causing.

it is a sad commentary on the legacy of the founders of this great nation that what began with a concensus that the States needed an effective form of federal government to guarantee the rights of individuals has deteriorated on the right into an almost religious belief system that dictates that all government is inherrently evil.
