i am wondering why the RIAA isn't filing lawsuits against Hub owners and such on Direct Connect. is it because its a different kind of program / different way of trading files?

the reason they nabbed kazaa users is because they don't need to agree to anything before they check out what files you have. a lot of privates hubs have connect messages like "if you are acting on behalf of the RIAA or any government organization, disconnect now" or something to that extent. the ftps that don't have messages like that are the ones who get nabbed.

I am sure that would stop them. That sounds really legal. No lawyer would be able to tear that apart.
